FBR Gets Additional Powers to Investigate Tax Fraud: A New Era of Accountability in Pakistan’s Tax System

Islamabad: In a significant move aimed at tightening the noose on tax evasion and enhancing transparency in revenue collection, the Federal Board of Revenue (FBR) has been granted additional investigative powers to deal with cases of tax fraud. This development marks an important step in Pakistan’s ongoing struggle to curb financial crimes, plug revenue leakages, and ensure a fair and just taxation system.

The FBR’s new powers come as part of recent legislative amendments designed to improve tax compliance, strengthen enforcement mechanisms, and leverage digital data for better tracking of suspicious financial activities. These powers also bring Pakistan closer to international standards of financial transparency, aligning with the recommendations of global watchdogs like the Financial Action Task Force (FATF).


Mandatory Data Sharing by Telecom, Internet Companies, and PTA

One of the most notable changes is the introduction of a mandatory information-sharing requirement for internet service providers (ISPs), telecom companies, and the Pakistan Telecommunication Authority (PTA). Under the revised rules:

  • Internet companies will be required to share subscriber data directly with the FBR.
  • Telecom companies will be obliged to provide detailed information on their customers, including records that may help establish income sources and verify tax declarations.
  • The PTA will serve as an additional channel for obtaining relevant data in cases where further authentication or supplementary details are required.

According to the FBR, this measure is essential for detecting under-reported income, uncovering tax evasion networks, and linking lifestyle patterns with declared income levels. This kind of cross-referencing between telecommunications usage and income statements has proven successful in other countries to identify individuals who may be hiding taxable income.


How This Will Work in Practice

When a tax fraud investigation is initiated, the Commissioner Inland Revenue will now be able to directly request subscriber information from telecom or internet companies. This can include:

  • Internet usage details to identify high-value transactions or services that suggest undeclared income.
  • Call records and mobile phone registration data to locate individuals or businesses engaged in suspicious activities.
  • Device registration details to establish ownership patterns linked to undeclared assets.

Such information will be cross-checked against tax returns, bank statements, and other financial documents to identify discrepancies.


Appointment of Auditors and Experts

The FBR’s amended law also empowers the appointment of specialized auditors for tax fraud investigations. These auditors will be responsible for:

  1. Conducting forensic audits of financial records.
  2. Tracing hidden assets through digital footprints.
  3. Assessing the true market value of properties and investments.

Importantly, these auditors are bound by strict confidentiality clauses to protect the sensitive data of taxpayers. Government employees, as per existing regulations, are already under a legal obligation not to disclose taxpayer information to unauthorized parties.

Additionally, the Board or Commissioner Inland Revenue can now appoint subject matter experts—such as IT specialists, valuation experts, or financial analysts—to assist in complex cases. This is expected to enhance the quality and accuracy of investigations, especially in highly technical matters involving digital transactions or cryptocurrency.


Why These Powers Were Needed

1. Tackling Chronic Tax Evasion

Pakistan has long suffered from low tax-to-GDP ratios compared to regional economies. According to recent studies, a significant percentage of taxable income remains undocumented due to loopholes, weak enforcement, and limited access to taxpayer data.

2. Moving Towards Digital Tax Enforcement

In a digital economy, traditional tax collection methods—relying solely on manual record checks—are increasingly ineffective. Fraudsters often use online platforms, e-commerce sites, and digital payment systems to conceal taxable income.
The new powers enable the FBR to access digital trails and better align tax enforcement with the realities of modern commerce.

3. Compliance with International Obligations

International financial institutions and trade partners have been pressing Pakistan to improve tax compliance and financial transparency.
Strengthening the FBR’s investigative powers helps fulfill OECD and FATF recommendations on anti-money laundering and counter-terror financing.


Balancing Enforcement with Privacy

While the new rules significantly strengthen the FBR’s reach, they also raise concerns over citizen privacy and data security. Critics argue that such broad access to telecom and internet data could be misused for political or personal purposes if not properly regulated.

To address this, the law mandates:

  • Confidential handling of all taxpayer data.
  • Severe penalties for officials or auditors who leak or misuse information.
  • Judicial oversight in sensitive investigations to ensure that due process is followed.

The FBR has assured the public that only authorized officials will have access to this information and that it will be used strictly for legitimate tax investigations.


Impact on Businesses and Individuals

For business owners, the new powers mean that the FBR can more easily verify whether declared income matches actual sales, transactions, and assets. For example:

  • A restaurant claiming low annual revenue could be flagged if its internet payment gateway data shows significantly higher transactions.
  • A trader declaring modest income might be questioned if telecom records show frequent international calls to suppliers of high-value goods.

For individuals, lifestyle audits may become more common. If someone declares minimal taxable income but maintains multiple high-value mobile connections, subscribes to expensive internet packages, or frequently engages in large online purchases, they could attract scrutiny.


Possible Challenges Ahead

Despite the potential benefits, there are several implementation challenges:

  1. Data Accuracy – Telecom and internet company records may contain outdated or incorrect subscriber information due to poor KYC (Know Your Customer) compliance.
  2. Technical Integration – Linking FBR’s systems with telecom and PTA databases requires secure and efficient IT infrastructure.
  3. Public Trust – Citizens need assurance that the data will not be used for harassment or unrelated investigations.

Expert Opinions on the Move

Tax experts have welcomed the decision, saying it will help bridge Pakistan’s revenue gap. According to Dr. Khalid Mahmood, a senior tax consultant:

“The FBR’s enhanced powers will make it much harder for habitual tax evaders to hide behind fake identities or unregistered businesses. This is a big step towards a documented economy.”

However, digital rights advocates, such as the Digital Privacy Forum, have cautioned that:

“Any expansion of state surveillance powers must be accompanied by clear safeguards, transparency mechanisms, and independent oversight.”


A Step Towards a Documented Economy

Pakistan’s undocumented economy is estimated to be worth billions of dollars annually. Strengthening the FBR’s investigative capacity is seen as essential for:

  • Boosting tax revenue without increasing rates.
  • Reducing the fiscal deficit.
  • Funding public services and development projects.

The new powers could also help eliminate the culture of selective enforcement, where only certain sectors or individuals were targeted while others operated outside the tax net with impunity.


Conclusion

The FBR’s newly granted powers to investigate tax fraud—including mandatory data sharing from telecom, internet companies, and the PTA—represent a major shift in Pakistan’s taxation landscape. If implemented transparently and efficiently, these powers could significantly improve tax compliance, enhance state revenues, and promote economic fairness.

However, success will depend on careful balancing between enforcement and privacy, robust data protection measures, and a commitment to non-discriminatory application of the law. In the long run, this reform has the potential to make Pakistan’s tax system more modern, transparent, and equitable—while sending a strong message to tax evaders that the era of hiding in the shadows is coming to an end.
