The Supreme Court rejected the plea of Muslim League (N) leader Ali Gohar Baloch for re-counting in NA-97 constituency of Faisalabad.
A two-member bench consisting of Justice Aminuddin Khan and Justice Naeem Akhtar Afghan heard the case.
During the hearing, the court inquired from the record when the request for recount was made. However, the petitioner and leader Muslim League (N) Ali Gohar Baloch’s lawyer could not show the application to the returning officer.
At the same time, the Election Commission also confirmed that the application was not received.
DG Law Election Commission said that there is no such application on record.
Later, the court dismissed the appeal of Muslim League (N) leader Ali Gohar Baloch.
It should be remembered that on May 29, the Lahore High Court annulled the Election Commission’s decision to conduct a recount after consolidating the results of the February 8 elections in NA-97.
Justice Shams Mehmood Mirza gave this order on the petition of PTI-backed independent candidate Mohammad Saadullah.
The petitioner through his lawyer took the stand that he was initially declared successful in the election, but the Election Commission ordered a recount on the request of the respondent Ali Gohar Khan of the Muslim League (N).
He said that the commission had declared the victory of the respondent in the recount.
Saadullah said that the commission’s wrong decision to conduct a recount after consolidating the results is illegal.
Later, Ali Gohar Baloch challenged the Lahore High Court’s decision in the Supreme Court.
