Islamabad: The Supreme Court has issued a written decision in the case related to NAB amendments. In the unanimous decision written by the Chief Justice, it has been said that the NAB law was made 34 days after former Army Chief Pervez Musharraf came to power by force.
The court verdict said that Pervez Musharraf threw out the constitutional democratic order and made legislation for himself. Pervez Musharraf removed those judges of the Supreme Court who did not extend the unconstitutional measure.
In the preamble of the law made during the Musharraf era, it was written that the purpose of the NAB law is to curb corruption. The politicians or political parties who joined Pervez Musharraf were acquitted. The main purpose of the NAB law was political revenge or political engineering to the politicians.
The court further said in its judgment that the Supreme Court should try to preserve the legislation instead of scrapping it early. If there are two interpretations of a law, the interpretation in favor of the law shall be accepted.
The Supreme Court declared that the petition and the decision of the Supreme Court are not in accordance with the Constitution. In the present case also we are not convinced regarding the unconstitutionality of the amendments. Imran Niazi himself was the architect of many of these amendments. Founder PTI did not file the application in good faith.
