Islamabad: The Constitutional Bench of the Supreme Court has taken the first suo motu notice for the recovery of a child kidnapped in Quetta and sought a report.
Hearing A six-member larger bench headed by Justice Aminuddin Khan heard the petition regarding missing children. The Constitutional Bench has summoned all IGs and Home Secretaries for the next hearing.
Justice Jamal Mandokhel remarked that not a single kidnapped child has been found in Quetta for six days, the entire Quetta has been blocked by protests but the government does not care, school children have also taken out a procession in Quetta.
Justice Musarat Hilali inquired whether sex trafficking has been declared legal in KP? In its report, KP has written sex trafficking as zero, how can there be zero sex trafficking.
Justice Muhammad Ali Mazhar said that is there any institution or commission in any province that is working on abducted children, after the 18th Amendment, now the provinces have the powers.
Justice Mandokhel said that the entire province is closed due to the abduction of a child, but the government is not worried. Justice Aminuddin Khan said that the Balochistan government is not able to find a single child. Justice Musarat Hilali said that abduction of children is an important issue and the government lawyers are not prepared for it.
Justice Mandokhel remarked that the case has been going on since 2018 and till now children are being abducted, every other case is about abduction of children, the Supreme Court formed a committee on abduction of children, which has not worked till date.
The petitioner said that the Supreme Court committee has not been formed till date. Additional Advocate Balochistan said that I will submit a report on the abduction of children to the court.
Justice Muhammad Ali Mazhar said in his remarks that we do not want a report, but we want a remedy and action for the abduction of children. Justice Mandukhel said that I will request the head of the bench to call all the IGs, what is happening in this country?
Justice Musarat Hilali said that the KP report has cast doubt on everything, the border is open from all sides, so is such a good good report possible, ensure the rule of law.
Justice Aminuddin Khan directed that a detailed report be given on how many children were abducted and how many were rescued.
Justice Mandukhel said that billions are spent on FC, what is their role in social welfare? Justice Hassan Azhar Rizvi said that children in Karachi beg at traffic signals.
Head of the Constitutional Bench Justice Aminuddin Khan said that we have now become international in sending beggars, how shameful it is for beggars to go abroad.
The Constitutional Bench adjourned the further hearing of the case till November 28.
