The Sindh High Court has ordered the Karachi Development Authority (KDA) to take action after illegal constructions were found to be taking place in Mujahid Colony without a master plan.
Residents of the Mujahid Colony area of Karachi had approached the Sindh High Court to stop the action against illegal constructions.
The Sindh High Court issued the order while disposing of the petition of more than 70 residents of Mujahid Colony, in which it has been stated that it has been revealed that illegal constructions have been carried out without a master plan.
The order issued by the Sindh High Court states that if illegal constructions have been carried out in Mujahid Colony, then KDA can take action according to the law.
The court has clarified that KDA should take action only against those illegal constructions that are not in accordance with the master plan.
It should be remembered that in the petition filed in the Sindh High Court, the petitioners had taken the position that if the KDA demolishes the structures that are not in accordance with the master plan, then we have no objection to it.
It should be noted that in November 2022, the authorities declared several houses in Mujahid Colony near Nazimabad as illegal and carried out demolition operations. During this time, many political parties had also expressed solidarity with the victims. Political leaders had also announced to protest if the demolition operations were not stopped.
To express solidarity with the victims, Farooq Sattar of the Muttahida Qaumi Movement (MQM) Pakistan, Pakistan Tehreek-e-Insaf (PTI) leader Khurram Sher Zaman and other political leaders visited Mujahid Colony.
Dr. Farooq Sattar had said that ‘127 houses have been demolished so far, I stand with the affected people, now no one has the courage to demolish more houses’.
The Karachi Development Authority (KDA) had said that it would remove the encroachment from Mujahid and Wahid Colonies, which are located on government land, and construct a 150-foot-wide road from Nazimabad 7 to Ziauddin Hospital at a cost of Rs 50 million.
Later, residents of Mujahid Colony had approached the Supreme Court and filed petitions to stop the KDA authorities from demolishing the houses, the decision of which was announced by the Supreme Court today.
