A reference has been filed against Lahore High Court Justice Shams Mahmood Mirza in Supreme Judicial Council to remove him from office.
The reference was filed by Assistant Attorney General Shiraz Zaka. The reference stated that the case of a private company against the Ministry of Petroleum has been pending in Justice Shams’ court for 7 years. At each hearing, Justice Shams Mahmood Mirza extends the restraining order issued to the petitioner company.
According to the reference, the said case was scheduled for hearing three times in the last one and a half years. The petitioner said that he appeared in the court as Assistant Attorney General on behalf of the Federation and the FIA for the said case. Justice Shams Mahmood Mirza has been deliberately favoring the petitioner for seven years.
The reference filed said that the said case is related to petroleum levy of Rs 401 million, according to the inquiry in the FIA, the government of Pakistan suffered a loss of Rs 401 million, the ongoing inquiry in the FIA was stopped due to the stay order of Justice Shams.
The reference said that it is necessary to show the incompetence of Justice Shams Mehmood Mirza, after the 26th Amendment, a judge can be removed for showing incompetence. The reference said that under Article 209 of the Constitution, a petition is filed to remove Justice Shams Mehmood Mirza from office.
