Islamabad High Court Overturns Conviction in Cypher Case

The Islamabad High Court has issued a detailed decision to quash the conviction of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and Vice Chairman Shah Mehmood Qureshi in the high-profile Cypher case. The decision, which spans 24 pages, states that the prosecution completely failed to establish a case against the accused.

Former Chief Justice of the Islamabad High Court, Aamir Farooq, and former judge Justice Miangul Hassan Aurangzeb had issued a short verdict on June 3, 2024, accepting the appeals filed by Imran Khan and Shah Mehmood Qureshi against their convictions. This latest detailed decision further elaborates on the procedural flaws and lack of evidence that led to their exoneration.


Key Findings of the Court’s Decision

1. Flawed and Hasty Trial Proceedings

According to the court’s detailed decision, the trial was conducted in an unnecessarily rushed manner. It was noted that:

  • A public prosecutor was hastily appointed after the defense lawyers sought an adjournment.
  • The appointed prosecutor was given only one day to prepare for the case.
  • The cross-examination revealed the prosecutor’s inexperience and lack of time to build a strong case.

The court observed that due process was not followed, leading to serious doubts regarding the fairness of the proceedings.

2. Insufficient Evidence Against the Accused

The verdict emphasized that even if the cross-examination was disregarded, the prosecution’s evidence was still insufficient to substantiate the allegations. The ruling stated:

“The prosecution has completely failed to prove its case. The evidence provided does not establish guilt beyond a reasonable doubt.”

With this conclusion, the court ruled in favor of the defendants, ultimately dismissing the charges.


Understanding the Cypher Case

What is the Cypher Case?

The Cypher case revolves around a diplomatic document that allegedly went missing while in the possession of former Prime Minister Imran Khan. PTI claimed that this document contained a message from the United States, threatening to remove Imran Khan from power.

Charges Filed Against PTI Leadership

Shah Mehmood Qureshi was among the primary individuals named in the First Information Report (FIR) filed by the Federal Investigation Agency (FIA). The case was registered under:

  • Section 5 (misuse of information) of the Official Secrets Act
  • Section 9 of the Official Secrets Act
  • Section 34 of the Pakistan Penal Code (PPC)

According to the FIR:

  • On March 7, 2022, the then Foreign Secretary received a diplomatic cypher from Washington.
  • On October 5, 2022, the FIA’s Counter-Terrorism Department officially registered a case, implicating Imran Khan, Shah Mehmood Qureshi, Asad Umar, and others.
  • The case accused them of distorting facts contained in the cypher, endangering national security, and using the document for political gain.

Allegations in the FIR

The case stated that:

  • The accused held a secret meeting on March 28, 2022, at Bani Gala (Imran Khan’s residence) to discuss the cypher.
  • The document was allegedly misused to “achieve their nefarious purpose” and “hatch a conspiracy.”
  • Imran Khan allegedly instructed his then Principal Secretary, Muhammad Azam Khan, to alter the minutes of the cypher meeting for political gain.
  • The classified document was allegedly kept by Imran Khan and not returned to the Ministry of Foreign Affairs, violating state security protocols.
  • The unauthorized acquisition and misuse of the document reportedly compromised Pakistan’s entire cypher security system, posing a risk to the country’s diplomatic communications.

The FIR further alleged that these actions benefited external powers while harming Pakistan’s national interests.


Court’s Observations on the Case

The Islamabad High Court, in its ruling, highlighted multiple weaknesses in the prosecution’s case:

  • Lack of Direct Evidence: The prosecution was unable to present concrete proof linking Imran Khan and Shah Mehmood Qureshi to the misuse of the cypher.
  • Weak Testimonies: Witness statements failed to substantiate the claims made in the FIR.
  • Political Motivations: The court also raised concerns that the case appeared politically motivated rather than based on strong legal grounds.
  • Violation of Legal Norms: The rushed nature of the trial proceedings indicated an apparent disregard for the due process of law.

Why the Conviction Was Overturned

The Islamabad High Court ruled that:

  1. The prosecution did not present sufficient evidence to justify a conviction.
  2. The accused were not granted a fair and impartial trial.
  3. The handling of the case suggested a pre-determined agenda rather than an objective legal pursuit.

With these considerations in mind, the court nullified the convictions of Imran Khan and Shah Mehmood Qureshi, ordering their immediate release from legal charges.
