Islamabad: The hearing of the May 9 GHQ attack case is ongoing in the Anti-Terrorism Court, however, the indictment against the founder of PTI and others has been postponed for the third time.
Before the Judge of the Anti-Terrorism Court Amjad Ali Shah, the lawyers of Sheikh Rashid Ahmed, Amjad Khan Niazi, Omar Tanveer Butt, Wasiq Qayyum, Major Tahir Sadiq, Omar Ayub and others presented their arguments.
On this occasion, the prosecutors objected to giving arguments without power of attorney and took a stand in the court that only those lawyers who have filed power of attorney should present arguments. Public Prosecutor Zaheer Shah said that the lawyers of the 102 accused named in the case do not have power of attorney. He requested that the court appoint a State Counsel to pursue the cases of the accused.
In addition, the lawyers of Shireen Mazari and Shakeel Niazi and others also completed their arguments, after which the prosecution presented arguments.
The court ordered the government lawyers to present arguments today on the acquittal applications of Sheikh Rasheed, Shireen Mazari, Amjad Niazi and others, while allowing all the accused who appeared to leave after their appearance.
Later, the court directed to distribute additional copies of the challan to the accused who did not appear in the GHQ attack case and adjourned the hearing till November 25. The government lawyers will present counter-arguments on the acquittal applications on a future date.
Before the hearing, the court had also summoned Shah Mehmood Qureshi from Lahore. Apart from him, the court had also issued a summons notice to Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur for indictment.
It should be noted that in the hearing of the GHQ attack case of the May 9 tragedy to be held today, all 125 accused, including the founder of PTI, were likely to be indicted.
PTI leader Omar Ayub, while speaking to the media on the occasion of his appearance in court, said that I have come today for the proceedings of indictment. I have appeared in court, I had appeared last time too. Our preparations are underway regarding November 24, we will protest and will definitely do so.
Later, PTI lawyer Muhammad Faisal Malik, while speaking to the media, said that there has been progress in the GHQ Gate attack case today, on which there are reservations. Earlier copies have been distributed, the prosecution prepared some new copies today. These copies were not available earlier, these copies were given to the accused through the court. This inspection note is the result of forgery.
He said that we have told the court that every accused has the right to a fair trial. The documents that were not in the challan have no legal status. Amjad Ali Khan has been acquitted by the Sargodha ATC. Copies will be distributed to Shah Mehmood Qureshi today. Hopefully, the court will fulfill all the requirements of a fair trial. Our objection was that the inspection note was not there earlier, so bringing it now is a forgery.
Faisal Malik said that we were not given any footage, no such CCTV footage was given to us. Ali Amin Gandapur is busy with government affairs, his attendance has been excused. Two people including Zartaj Gul have also been excused from attending. The legal team was not allowed to meet Imran Khan, today they have requested to meet the court again.
He said that a story has been written about the element of conspiracy. There is no evidence according to the parameters of the evidence. Such evidence which Sargodha ATC has rejected, the same evidence is being presented here.
