ISLAMABAD: Justice Hassan Azhar Rizvi has said that inappropriate remarks were made about former judges in the NAB amendment decision.
Additional note of Supreme Court judge Justice Hasan Azhar Rizvi was issued in NAB amendments case.
Justice Hassan Azhar Rizvi said that he agreed with the decision but could not convince himself on the validity of the reasons, the majority decision did not provide sufficient justification on the original claim.
In an additional note, he said that inappropriate remarks were made in the judgment regarding the former judges, judicial dignity requires that the disagreement be done within the realm of civility, the focus of criticism should be the legal principles of the judgment and not the judgment writers. To be mocked, I am writing my separate reasons for the decision keeping in mind civility and judicial dignity.
Justice Hasan said that the intra-court appeal under the Practice and Procedure Law is unique from the traditional appeals, the intra-court appeal in the Supreme Court is for re-examination of its own decision.
He further said that an intra-court appeal in the Supreme Court is not against the decision of a subordinate court, the bench hearing the intra-court appeal should not affect the facts of the case.
