The District and Sessions Court of Islamabad accepted the appeals against the sentence against former Prime Minister Imran Khan and his wife Bushra Bibi in the Iddat Nikah case and suspended their sentences of 7.7 years in prison.
Additional Sessions Judge Afzal Majuka was conducting the hearing on the central appeals, during the hearing Khawar Manika’s lawyer Zahid Asif Advocate and Imran Khan’s lawyer Imran Sabir, Murtaza Turi, Zahid Dar appeared in the court.
Lawyer Zahid Asif took the stand that if the accused want to present any more evidence, they can present it, we have no objection, adding that no party was asked about their jurisprudence.
Lawyer Zahid Asif argued that even Mufti Saeed did not say that the accused are from Hanafi jurisprudence, Salman Akram Raja says that his client PTI founder Imran Khan is married and he does not know about Iddat.
Lawyer Zahid Asif said that all the responsibility is being shifted on the shoulders of Bushra Bibi, the husband is keeping the woman’s sacrifices aside and saying that I have not done anything, the woman stood by her husband in difficult times.
Lawyer Zahid Asif continued his arguments and said that such a thing cannot be expected from a leader, his wife left the comfort of Bani Gala and went to Adiala Jail.
Lawyer Zahid Asif said that it was said on behalf of Bushra Bibi that verbal talaq was given in April 2017, if the woman says that she was given verbal talaq, will her verbal statement be believed, any status of verbal talaq. No, there are court decisions in this regard, the law says that documentary evidence will prevail over oral evidence.
Lawyer Zahid Asif said that in which statement did Bushra Bibi say that the marriage did not take place during Eid, Mufti Saeed performed Nikah on the request of Bushra Bibi’s sister that the marriage requirements were complete. He did not say that his period was complete, the sister who said that the period was completed would have been brought as a witness.
Judge Afzal Majuka said that it is the duty of the prosecution to prove that the period is not fulfilled. 16 Lawyer Zahid Asif said that on January 2024, Bushra Bibi was charged and denied the health crime, Bushra Bibi did not say that They got married on completion of Idda, founder PTI was charged over the statement, to which founder PTI said it was a false case and part of the London plan and aimed at destroying the party. Lawyer Zahid Asif said that the founder of PTI also did not say anywhere that he got married after the completion of Idda.
Lawyer Usman Gul said that we do not want the case to be remanded, but a decision on the appeals as per the timeline of the High Court.
Lawyer Zahid Asif said to show any statement of Bushra Bibi, in which it is said that she got married after completing Idda, there is no such statement in the entire case file, both the accused refused to appear in the court as a witness. Founder PTI and Bushra Bibi were the best witnesses in this case.
Lawyer Zahid Asif said that founder PTI and Bushra Bibi would have testified in their favor on oath, tampering was said on the divorce deed but no evidence was presented, we are satisfied that there is no tampering on the divorce deed, no one in April. Not Divorced November 2017 Khawar Manika gave a written divorce.
He adopted the position that the Holy Qur’an has the right to return during the period of Iddah and second marriage is allowed upon completion of Iddah, second marriage cannot be decided during Iddah. After hearing the arguments of the parties, the District and Sessions Court of Islamabad reserved judgment on the appeals against the sentence against former Prime Minister Imran Khan and his wife Bushra Bibi in the Iddat Nikah case, which will be pronounced at 3 pm.
Later, while issuing a safe decision, the court accepted the main appeals against the sentence in the marriage case and annulled the 7-year prison sentences of Imran Khan and his wife.
The court ordered the acquittal of PTI founder and former first lady and said that if she is not wanted in any other case, she should be released immediately.
