Islamabad: The Constitutional Bench of the Supreme Court dismissed the petition to declare candidates who got more than 50 percent votes successful in the election.

A 7-member Constitutional Bench headed by Justice Aminuddin Khan heard various cases. Justice Ayesha Malik, Justice Jamal Khan Mandokhel, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Naeem Akhtar Afghan and Justice Musarrat Hilali are included in the bench. The Constitutional Bench imposed a fine of Rs 20,000 on the petitioner for baseless litigation.

During the hearing, Justice Muhammad Mazhar said in his remarks that under which constitutional provision should a candidate be required to get 50 percent votes in the election, the successful candidate is decided on the votes cast in the election and what can happen to the voters if they do not go to vote.

Justice Ayesha Malik said in her remarks that first it should be told which fundamental right of the petitioner has been affected and which articles of the constitution are being violated. Justice Jamal Mandokhel said that if a new law is to be made, the Supreme Court does not have the authority.

Petitioner Akram said in his arguments that all fundamental rights are related to the question raised in this petition, Parliament decides our lives. Justice Aminuddin Khan remarked that Parliament does not decide our lives.

Justice Musarrat Hilali said in his remarks that all people have the right to vote, on polling day people watch TV but do not go to vote, if voters do not vote, it is the weakness of the voters.

Justice Mandokhel asked whether you voted in the February 2024 elections? Petitioner Muhammad Akram replied that he did not vote in the elections. Justice Jamal Mandokhel remarked that you are insulting the Ahan again.

The constitutional bench imposed a fine of Rs 20,000 on the petitioner for baseless litigation.

The petitioner said that a fine of at least Rs 100 billion should be imposed so that the country’s debt is reduced, to which Justice Aminuddin Khan remarked that it is not in your position to impose a fine of Rs 100 billion.

Case of making independent candidates mandatory to join political parties

When the constitutional bench began hearing the appeal regarding making independent candidates mandatory to join political parties, the petitioner Maulvi Iqbal Haider appeared through video link and said that this matter has been settled, my petition has become ineffective.

Justice Aminuddin Khan said that you were allowed to enter the court premises, this is enough for you. The constitutional bench disposed of the petition on the basis of being ineffective.

Hearing on 1178 petitions against Income Levy Tax Act 2013

During the hearing, the FBR lawyer said that many parties to the case could not be served notices, the decisions of two High Courts in Lahore and Karachi have been challenged in the case, the addresses of 400 people may not be correct.

The constitutional bench ordered that the notices be served through newspaper advertisements.

The FBR lawyer said that the case also includes the issue of admissibility of appeals. The court said that it will hear this issue in the next hearing. The bench adjourned the further hearing of the case for three weeks.
