Islamabad: The High Court has given remarks in the case related to NAB amendments that whether the Acting President can pass the ordinance or not?
A hearing with objections on the petition filed against the NAB Amendment Ordinance 2024 was held in the Islamabad High Court, in which Chief Justice Amir Farooq removed the objections on the petition. Advocate Muhammad Azhar Siddique appeared in the court on behalf of the petitioner, Shehri Malik Najiullah.
During the hearing, the lawyer told the court that in the new amendment ordinance, the remand period has been increased from 14 to 40 days and the punishment of the officer who prosecuted the case for malice has been reduced from 5 to 2 years. PDM has amended NAB rules 3 times. Now this new amendment ordinance has come which has not been presented in the Parliament.
The lawyer further stated in his arguments that remand for more than 14 days is a violation of fundamental human rights. Why is the punishment of the officer who made a malicious false case only 2 years? Accused in NAB references serve 14, 14 years sentences. This is a cruel law, the amendment ordinance should be withdrawn immediately. This Ordinance was also passed without taking it to the Parliament, it is against the intention of the law.
Chief Justice Islamabad High Court remarked that the important question is whether the Acting President can pass the ordinance or not? The court issued notices to the Attorney General and other parties, directing them to look at the decisions of the Supreme Court and the Islamabad High Court regarding the Presidential Ordinances and sought their response.
The court adjourned the hearing of the case till August 6.
