Supreme Court of Pakistan Judge Justice Ayesha Malik has recused herself from hearing a case regarding the constitutional status of Section 221A of the Customs Act.
The appeals regarding the constitutional status of Section 221A of the Customs Act were heard in the Constitutional Bench, headed by Justice Aminuddin Khan, and an 8-member Constitutional Bench heard the case.
During the hearing, Justice Ayesha Malik recused herself from hearing the case, saying that she cannot hear the case, and will give separate reasons for that.
The Attorney General said that the case should be adjourned for a week, while lawyer Barrister Salahuddin said that there is a lot of controversy in this matter, an order regarding powers has also come, the Dewan Motors case should be heard soon.
Justice Aminuddin Khan said, “Okay, we will hear this case tomorrow.” Justice Ayesha Malik remarked that I will give different reasons for withdrawing from the case. Justice Muhammad Ali Mazhar said, “Okay, you give your reasons.”
