Islamabad: During the hearing of the case related to taxation in the Supreme Court, Justice Mansoor Ali Shah remarked that there is no constitutional bench at the moment, so what should the unconstitutional bench which is sitting do, until the constitutional bench sits? Are unconstitutional?
A three-member bench headed by Justice Mansoor Ali Shah heard the tax-related case.
During the argument, the Constitutional Bench was mentioned, on which Justice Ayesha Malik said that the Constitutional Bench will hear this case, we are hearing the regular bench.
Justice Mansoor Ali Shah remarked that until the constitutional bench sits, the constitutional cases will not be heard. Even if we hear this case, no one can ask us. Or a constitution bench, what if we decide the case?
Justice Mansoor Ali Shah while giving remarks said that if we decide ourselves, who is going to stop us? If the revision comes to us, then we will say that we have jurisdiction, the regular bench cannot hear constitutional cases and there is no support from lawyers.
Justice Aqeel Abbasi raised the question whether we can hear this case now or not. Justice Mansoor Ali Shah said that if we give some time, we will see what happens.
Justice Ayesha Malik remarked that according to Article 2A, the Practice and Procedure Committee will decide whether it will be heard by a constitutional bench or a regular bench, which will take time.
Justice Mansoor Ali Shah smilingly remarked that we cannot give any point of view to your request, we postpone it, we are just gossiping.
The Supreme Court adjourned the hearing of the case indefinitely.
