Karachi: The Sindh High Court’s constitutional bench has rejected a student’s petition against the cancellation of admission to Benazir Bhutto Medical College Lyari.
A two-member constitutional bench headed by Justice KK Agha issued a written order on the petition regarding the admission dispute to Benazir Bhutto Medical College Lyari and the constitutional bench rejected the student’s petition against the cancellation of admission.
The court ordered Benazir Bhutto Medical College Lyari to refund the admission fee of the applicant student.
The written order states that this matter is quite disturbing for the applicant. The applicant had a dream of becoming a doctor, which is in danger in the current situation. Individually, we all sympathize with the applicant, but as judges, we are bound to decide according to the law.
The court also summoned the principal of Shaheed Mohtarma Benazir Bhutto Medical College and PMDC for assistance. The court tried to resolve the matter within the legal framework with the support of the parties, but this could not be done. Many students dream of pursuing MBBS and becoming a doctor. PMDC is bound to allot a limited number of seats.
According to the decision, the court cannot issue a directive to PMDC to increase the admission quota. In case of doing so, a tradition will be established which will have negative consequences. The student is left with the only option of changing seats with another student. The admission rules are clear that admissions are provisional before the closure of the PMDC portal. Apparently, there may be malice in the student’s action.
The written order further states that despite the advice of the student to return to the original educational institution, the student hastily approached the court and obtained a stay order. This responsibility also lies with the judges who could not decide on the application immediately, the decision was made a few days before the exams.
The court accepts that the admission till March 31 was on a provisional basis. Meanwhile, the documents of the student on the merit list were verified. The mistake in the admission dispute was not the student or the medical college, but the selection committee. If the applicant wants, she can withdraw her original admission in the BDS department of KMDC. For this, it is necessary that the original seat of the student is still vacant.
