ISLAMABAD: The Supreme Court has issued a decision rejecting the petition against changing the election results in Naseerabad.
According to the decision of the Supreme Court in PB 14 Naseerabad on the petition regarding recounting of votes and alteration of election results, if the recount of votes is done, Forms 45 and 47 cannot be said to be final determination.
The 4-page judgment written by Chief Justice of Pakistan Qazi Faiz Isa said that the cast ballot papers are the primary evidence in the election result. When a candidate applies for a recount, if the application is approved, the recount takes place in the presence of the candidates. There is no case before the court that the seals of election bags are broken. After the voting process is completed, the presiding officer prepares Form 45 after counting the votes of each polling station.
According to the decision, the Returning Officer counts all the votes of Form 45 sent by the Presiding Officer and issues Form 47, then the Returning Officer sends the result to the Election Commission. The ballot papers cast have the status of determining factor. When the votes are recounted by opening the ballot bags, the forms of the Presiding Officer or the Returning Officer cannot be said to be final. The allegation of altering election results by using influence was not proved.
