Justice Aqeel Abbasi declared that the order given by the Election Commission on election disputes is beyond jurisdiction, the Lahore High Court ruled on the powers of the Election Commission and not on the election dispute, under Article 199, the High Court reviews any illegal action. is authorized to take.
According to the dissenting note, the work of the returning officer is not just a post office, it is the authority and prerogative of the returning officer to reject the request for recount, the election process will be controversial if the power to reject the request for recount is lost.
The note further said that the Returning Officers and the High Court had not given any decision on the election dispute, during the hearing of the appeal in the Supreme Court, a decision cannot be given on the election dispute, there is no constitutional or legal validity in the Lahore High Court decision.
