New Delhi: The Supreme Court of India has given its verdict on the request of a Muslim citizen not to give non-maintenance to his divorced wife. According to the decision, Muslim divorced women also have full right to non-maintenance under the laws of the country.
According to foreign news agency Ejsini, the important case filed by a citizen named Muhammad Abdul Samad was heard by Supreme Court Judge Augustine George Masih and Justice BV Nagarathana.
It may be recalled that the plaintiff had earlier approached the Telangana High Court against the family court’s order to pay monthly non-maintenance to the divorced woman, but the court declined to intervene.
Later, Muhammad Abdul Samad reached the Supreme Court with his petition, but the case was also dismissed in the Supreme Court.
The Supreme Court judges in their judgment wrote that the country’s law of non-maintenance applies to all married women irrespective of their religion.
Justice BV Nagarathana remarked that some husbands do not know that the wife is the architect of the house. She is emotionally and financially dependent on her husband.
The judge further said that Indian men have to recognize the sacrifice of a woman’s role as a homemaker.
