ISLAMABAD: The court has adjourned the hearing till April 9, seeking arguments from Khawar Manika’s lawyer in the Iddat marriage case of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and Bushra Bibi.
District and Sessions Judge Islamabad Shahrukh Ajmand heard the petitions against the 7-year imprisonment awarded to founder PTI and Bushra Bibi in the Nikah case in Iddat where Imran Khan and his wife’s lawyer Salman Akram Raja gave arguments. And requested that the sentence be suspended before Eid.
Founder PTI’s lawyer Salman Akram Raja argued that the dates of divorce and end of Idda are important, according to Khawar Manika, he divorced Bushra Bibi three times on 14 November 2017.
He said that Bushra Bibi was denied the right to present her evidence in the civil court, she could not withdraw from the divorce on 14 November 2017. By 1 January 2018, 48 days had passed since the divorce.
The lawyer said that there are verses in Surah Al-Baqarah regarding Iddah, the Supreme Court adopted the verses regarding Iddah in Surah Al-Baqarah, 48 days after divorce, Bushra Bibi and the founder of PTI got married.
Salman Akram Raja referring to the Supreme Court’s Rashida Akhtar case decision said that every court has to adopt the Rashida Akhtar case decision of the Supreme Court. After the ceremony is held, there can be 10 ceremonies after the marriage.
said that Khawar Manika remained silent for 6 years and filed a complaint on one sentence, in Islam it is recommended to take care of the woman’s privacy. Punishment is due to the intention of fraud, Bushra Bibi has been accused of marrying during the Idda a few years ago.
Salman Akram Raja argued that Khawar Manika said that he had not seen a more pious woman than Bushra Bibi, on which the court inquired that in the cross-examination related to the video clip, Khawar Manika gave a statement and the lawyer told Khawar Manika that the employee used to tell Latif. I used to say ban them.
The court inquired whether there is a date of Khawar Manika’s interview. The lawyer replied that Khawar Maneka had given a statement about Bushra Bibi in Naji T-show, will get the entire record of the interview from Naji TV, Khawar Maneka lied in court about which interview she had given such a statement, January 2018. After Khawar Manika said that all the allegations leveled against Bushra Bibi and founder PTI are false.
The lawyer said that Khawar Manika later told that he did not remember any interview, the civil judge had pronounced the sentence on the day after the statement was recorded in the court, we were not given a chance to speak. PTI had said that they had never seen Bushra Bibi before January 1, 2018, while Khawar Manika disappeared and on her return she said that she was cutting chala. It has been said that pressure and threats are given.
Salman Akram Raja read the 342 statement of the founder of PTI in the trial court and said that the founder of PTI gave a statement in the court for 5 years and 11 months then Khawar Manika did not file any complaint.
In his arguments, the lawyer said that the founder of PTI gave a statement in the court that Aoun Chaudhry was awarded for becoming a witness. The founder of PTI gave a statement in the court. All the witnesses were arrested.
Salman Akram Raja took the stand that Eid is upon him, Bushra Bibi’s health is also not good and she has only been sentenced in the marriage case during Eid, so see the request to suspend her sentence today.
The lawyer said that Rizwan Abbasi has been sitting in the adjacent court for many hours, there are pictures but he left the court without telling what happened that Rizwan Abbasi can’t come back today, why can’t the punishment of a woman end today?
Lawyer Usman Gill took the stand that Prosecutor Rana Hasan Abbas is present, the notice was also given to the government, if Rizwan Abbasi is not present then Prosecutor Rana Hasan Abbas is present.
The District and Sessions Court adjourned till April 9 the hearing on the appeal against the conviction in the marriage case of founder PTI and Bushra Bibi.
