Karachi: Sindh High Court judge Justice Umar Sial has apologized for being part of the Supreme Court’s constitutional bench, disagreeing with the method of formation of benches and has informed the Chairman of the Constitutional Bench Committee, Justice Karim Khan Agha, through a letter.
Sindh High Court Justice Umar Sial wrote to the head of the bench in a letter that he is grateful to the Judicial Commission, which considered me worthy and made me a member of the constitutional bench. It is an honor for me and I have worked with the best judges in the judiciary of the province.
In the letter, he has said that every judge of mine is an expert and very capable in his work. In my opinion, all judges should hear constitutional cases. If this is not possible, these constitutional benches should be formed on the principles of seniority.
The Chief Justice of the Sindh High Court has disagreed on the names of judges for constitutional benches in the Judicial Commission, the opinion of the Chief Justice should prevail in the selection of judges.
Justice Umar Sial has written that my other senior judges can hear constitutional cases better.
The letter further states that the perception of the role of the administration in the appointment of judges is extremely dangerous, for whatever reason, the majority role of the administration has been included in the selection of judges, this situation shakes the foundations of democracy.
