Islamabad: Barrister Asad Rahim Khan has said that all the confusion is the result of refusal to hear the constitutional status of the 26th Amendment.
This amendment, which completely changes the structure of the judiciary, should have been heard immediately, but on the contrary, it has been lying in cold storage for 3 months.
On the other hand, the Supreme Court benches are surprised at the limits of their jurisdiction.
In a conversation with The Express Tribune, reacting to the situation of the Supreme Court, he said that fixing a date for hearing in the constitutional bench on the matter is not a solution because the constitutional status of this bench has been challenged, a constitutional bench cannot decide its own status.
Former Additional Attorney General Tariq Mahmood Khokhar said that the current situation is worse than the attack on the Supreme Court in 1997, the 26th Amendment and its supporters have subordinated the higher judiciary and its role to the administration.
The higher judiciary has been divided into groups of judges, with some judges more equal than others, which has resulted in many, including the Chief Justice, being barred from judicial review.
