In the Supreme Court, the hearing on intra-court appeals against the annulment of the NAB amendments is ongoing.
A 5-member larger bench headed by Chief Justice Qazi Faiz Isa is conducting the hearing, Justice Aminuddin, Justice Jamal Mandukhel, Justice Athar Minullah and Justice Hasan Azhar Rizvi are part of the larger bench.
PTI founder was produced in court through video link from Adiala Jail, Imran Khan was moved from barracks to courtroom.
Advocate Farooq H. Naik, giving arguments, said that I have prepared my written submissions.
The Chief Justice inquired that you should submit your submissions to the court, are you supporting the decision? Farooq Naik said that I support Justice Mansoor Ali Shah’s note.
Chief Justice Qazi Faiz Isa inquired whether you are adopting the arguments of Makhdoom Ali Khan? Farooq Naik said that my position is the same but the arguments are my own.
The Chief Justice asked Khawaja Haris that which fundamental right has been affected by the NAB amendments? Khawaja Haris said that in the main case, I have explained the violation of fundamental rights in detail, the NAB amendments are a violation of Article 9, 14, 25 and 24.
Justice Athar Manullah inquired whether your client was satisfied with the remand of 90 days. The way NAB used to make arrests, was it correct? Khawaja Haris said that many amendments in NAB are good, he was satisfied with 90 days remand and not with arrests, the amendments which were good were not challenged.
The Chief Justice inquired that when the NAB Ordinance came? Khawaja Haris said that the NAB law came in 1999, the Chief Justice inquired that whose government was in 1999? Name them, Khawaja Haris said that there was a government of General Pervez Musharraf, before Pervez Musharraf there was such an accountability act during the Nawaz Sharif regime.
The Chief Justice said that if the government of your client came, he would have restored the Accountability Act, Pervez Musharraf had said that the purpose of NAB is to remove corrupt politicians from the system, something similar was said on the request of founder PTI, Khawaja Haris. said that no politician’s name was written in our petition, the Chief Justice said that apparently the government of the founding PTI also only wanted accountability of politicians.
