The Islamabad High Court ordered to decide the appeal of the Iddat case within a month and the Sessions Court to decide on the request for suspension of sentence within 10 days.
Justice Mian Gul Hasan Aurangzeb heard the petitions of founder PTI and Bushra Bibi.
During the hearing, lawyer Salman Akram Raja argued that in his career, I have never seen a judge transfer a case like this suddenly, the session judge had heard the case, now the additional session judge has been transferred Why was the case transferred?
Salman Akram Raja said that our first request is that Sessions Judge Shahrukh Arjamand be directed to pronounce a safe decision, the High Court or itself should decide after hearing the appeal and the third case is that the appeal should be transferred to Sessions Judge West, the session court. The court should set a time to decide the appeal, Sessions Judge East was hearing, now the case should be transferred to Sessions Judge West, the trial took place in two days, now the appeals should be heard in the same way.
Khawar Manika’s lawyer Raja Rizwan Abbasi said in arguments that Khawar Manika objected to the judge and the court rejected the application, Khawar Manika objected again and the session judge sent the matter to the High Court. The High Court on the administrator side referred these appeals to Additional Sessions Judge West, the administrator order of this court cannot be directly or indirectly challenged.
Khawar Manika’s counsel opposed the transfer from Appellate Additional Sessions Judge to Sessions Judge.
After hearing the arguments of the parties, the court ordered to decide the appeal of the Iddat case within a month and the session court to decide on the request for suspension of sentence within 10 days.
It should be noted that the founder PTI requested to instruct the session judge to give a safe verdict, while otherwise the appeal was requested to be heard by the High Court itself. Bushra Bibi had requested the Sessions Court to hear and decide the pending sentence suspension petition.
