ISLAMABAD: The Supreme Court has stopped the candidates from giving their affidavits for the elections 2024 and the by-elections.
Justice Muneeb Akhtar issued a 10-page judgment written in the Umar Farooq nomination papers case. Umar Farooq was an independent candidate from NA 99 Faisalabad and PP 107.
The Supreme Court said that the judicial decision on the affidavit related to dual citizenship and assets was for elections 2018.
The Supreme Court said in the verdict that the decision on the affidavit given in the Habib Akram case is not applicable to the elections 2024, while no action can be taken against the candidate on the basis of not giving the affidavit in the elections 2024 and the by-elections.
The court decision said that if a fugitive can be eligible for advertisement elections, how can only a fugitive not be?
The court said that the High Court did not consider that Umar Farooq had taken bail in the criminal case. The Returning Officer rejected the papers for not being a verified affidavit and absconding. The Election Tribunal restored the papers and the High Court again rejected them.
In the decision, it was said that the Supreme Court had allowed Umar Farooq to contest the elections in a brief decision.
