ISLAMABAD: The Supreme Court has said in a decision that service tribunals can annul the decision of departmental proceedings, but this power requires extreme caution, no court has this power. Instead, give relief of your own accord.
A 5-page written judgment written by Justice Mansoor Ali Shah has been issued. The background of this case is that driver constables were recruited in District Police Lahore in 2077. Later, there was a complaint that the basis of fake LTV driving license. Recruitments were made, employees were fired after departmental action in 2021.
An appeal was filed against the departmental action which was rejected, the Punjab Service Tribunal Lahore accepted the appeal and reinstated the employees against which the Superintendent Police Headquarters Lahore approached the Supreme Court, the appeal was headed by Justice Mansoor Ali Shah and Justice Athar. A three-member bench comprising Minullah and Justice Malik Shahzad Ahmed Khan heard the case.
In the court decision, the Supreme Court has said that the primary job to punish under the law is the police department, the role of the tribunal or the court is secondary, the court overturned the decision of the service tribunal of 21 September 2021 and restored the decision of the departmental action. And the appeal was accepted.
