ISLAMABAD: The Islamabad High Court issued a notice to the Election Commission on the request of PTI Chairman and Deputy Chairman Senate to stop the election.
PTI decided to boycott the election of Chairman and Deputy Chairman Senate and filed a petition in Islamabad High Court to stop the election of Chairman Senate and Deputy Chairman Senate, to which the Registrar Office raised objections.
Chief Justice Islamabad High Court Justice Aamir Farooq heard the petition filed by PTI’s five senators Dr. Zarqa Suhrawardy, Falak Naz, Fauzia Arshad, Saifullah Niazi and Saifullah Abro with the objections of the Registrar’s Office.
In the petition filed by 5 PTI senators, it has been argued that as per the constitution, the total number of senate members is 96 with equal representation from all provinces. The number of 23 members from Khyber Pakhtunkhwa in the Senate is not complete. The Election Commission has postponed the Senate elections in Khyber Pakhtunkhwa. The election of the Chairman and Deputy Chairman of the Senate should be postponed until the number of members of the House is completed.
The Registrar’s Office has objected to the request that the case of Khyber Pakhtunkhwa Senate seats is under hearing in the Peshawar High Court.
Shoaib Shaheen Advocate said that there is a separate issue, it was the issue of specific seats, the Election Commission refused to give seats to the Sunni Ittehad Council, the Sunni Ittehad Council approached the Peshawar High Court against it, later the matter went to the Supreme Court. The commission postponed the Senate elections in Khyber Pakhtunkhwa for not taking oath on certain seats.
He said that the number of senate seats in all the provinces is equal, FATA has been merged into Khyber Pakhtunkhwa, now the senate elections have been held in the rest of the provinces and Islamabad, they have been postponed in Khyber Pakhtunkhwa. Now, without the senator of Khyber Pakhtunkhwa, the chairman and deputy chairman of the Senate are going to be elected tomorrow, tomorrow is the election, if it is stopped, it will be better, if it is held after Eid, what is wrong.
Later, the Islamabad High Court issued a notice to the Election Commission on the request of the chairman and deputy chairman of the Senate to stop the elections. In this regard, Chief Justice of Islamabad High Court Amir Farooq issued the order.
Apart from this, Tehreek-e-Insaf also submitted a petition to the Senate Secretary against the election of the Senate Chairman. The petition has the signatures of Senator Zarqa Taimur, Saif Abro, Falaknaz Chitrali, Fauzia Arshad and Saifullah Niazi.
Meanwhile, according to PTI Core Committee sources, the House of Federation is incomplete and the election of the Chairman Senate without electing senators in Khyber Pakhtunkhwa is also against the constitutional scheme. According to the committee, in the absence of the chairman, the senate is inactive and without the chairman of the senate, the upper house is limited to the extent of only one department. For the first time in the democratic era, the Senate has become inactive.
