Islamabad: The Supreme Court’s constitutional bench has dismissed the petition against the extension of the Army Chief’s tenure.
During the hearing of the cases, Justice Muhammad Ali Mazhar remarked that after the 26th Amendment, there is no more full court, while Justice Jamal Khan Mandokhel said that this 7-member constitutional bench should be considered as a full court now.
A 7-member constitutional bench headed by Justice Aminuddin Khan dismissed the petition against the extension of the Army Chief for lack of follow-up. The bench upheld the objections of the Registrar’s Office. No appearance was made by the petitioner during the hearing.
In the case related to the imposition of tax on underground water, the law officers of the Punjab and Khyber Pakhtunkhwa governments took the stand that we have made legislation. Justice Muhammad Ali Mazhar remarked that the other provinces should also make legislation, if the law is not made, the cases will continue for twenty years.
Justice Jamal Khan Mandokhel said that his work is not done, then they say that the courts do not work. During the hearing of the case related to tax on ghee mills, Justice Jamal Mandokhel said that the Balochistan High Court has already given a decision on it, I should not hear the case.
The lawyer of the petitioner said that the decision of the full bench is in this case. Justice Muhammad Ali Mazhar said that after the 26th constitutional amendment, there is no more full court. Justice Jamal Khan Mandokhel said that this 7-member constitutional bench should be considered as the full court now.
The court issued notice to all the provinces including the federation and adjourned the hearing for an indefinite period. The court dismissed the application on the issue of registering two FIRs on one incident as inadmissible.
Justice Jamal Khan Mandokhel remarked that the number of pending cases in the Supreme Court has reached sixty thousand due to such cases, we are reminded of these cases again and again, why not dismiss your application with a fine, Justice Ayesha Malik refused to hear the case related to payment of salaries to journalists, after which the hearing was adjourned.
The court sent the cases related to the Ministry of Petroleum and Housing Society back to the regular benches. Justice Ayesha Malik said that I was part of the regular bench, the case was sent to the constitutional bench on the request of the lawyer. The cases are sometimes going to one bench, sometimes to another bench, Justice Muhammad Ali Mazhar said that not every such case should be sent to the constitutional bench, if there is a constitutional question in a case, then send it.
