ISLAMABAD: The High Court ordered Islamabad Police not to take final decision on recruitment from other provinces on 50 percent quota.
The case related to the recruitment quota in the federal capital police was heard in the Islamabad High Court, in which the court restrained the federal police from taking the final decision on the recruitment from other provinces on the 50% quota.
Justice Mohsin Akhtar Kiani issued a hearing order on the request of Barrister SM Yawar Gurdizi, in which the court said that the process of recruitment in ICT Police will continue, the result of 50% quota of other provinces cannot be announced. The decision of the candidates having domicile of Islamabad for recruitment can be announced.
According to the court order, the parties have been directed to file para-wise comments till the next hearing. The court said that Attorney General and Advocate General Islamabad should appear before the court for assistance in the next hearing. The next hearing should be fixed on September 23.
It should be noted that the petitioner had taken a stand in the case that Article 25 of the Constitution speaks of equality. The Supreme Court has repeatedly declared Islamabad as a federal unit and the constitution also recognizes the separate status of Islamabad as a federal unit. Citizens of other provinces have the right to work in their own province, similarly citizens of Islamabad also have the right to work in Islamabad.
It was requested in the petition that the quota of other provinces for recruitment in institutions of Islamabad Capital Territory is illegal and should be abolished. As far as Islamabad is concerned, the quota of other provinces should be abolished in the recruitment of grades one to 15 under Civil Servants Rules 15 and 16 in federal institutions.
The petitioner further said in his request that the quota of Islamabad should be allocated in the posts from grade 16 to 22 in the federal government institutions which have the scope of the entire country. In the subordinate judiciary of Islamabad, the quota of civil and district judges of other provinces should be abolished and the 50% quota of other provinces in the ICT police should also be abolished.
