The hearing of the case against the Sunni Ittehad Council not getting specific seats is going on in the Supreme Court.
A 13-member full court bench headed by Chief Justice Qazi Faiz Isa is hearing the case regarding reserved seats.
The Chief Justice forbade Faisal Siddiqui, the lawyer of the Sunni Unity Council, from calling him Lordship, saying that there is no need to call Lordship, time can be saved.
“Yesterday I was asked to provide some basic legal questions,” said Faisal Siddiqui, a lawyer for the Sunni Ittehad Council.
Lawyer Faisal Siddiqui said that yesterday Justice Jamal Mandukhel’s question was why PTI did not contest the election as a party. Salman Akram Raja had applied for the same which was not approved.
Faisal Siddiqui argued that the petitioner Sunni Ittehad Council did not participate in the elections, if it did not participate as a party, then the independent candidates participated in the elections, the Sunni Ittehad Council gave a list of specific seats as per the schedule, the Election Commission Rejecting the request, he said that the Sunni Ittehad Council did not participate in the elections.
Chief Justice Qazi Faiz Isa asked whether all the documents related to the questions are there. Faisal Siddiqui replied that I have all the questions, I will also show all the documents in the court, there is no dispute that the Sunni Ittehad Council did not contest the elections.
The Chief Justice asked why you are talking about the conflict. Just say that you did not contest the election, full stop, in two places you have written parliamentary political party, in the third place political party, in the last place you have written party, is there any significant difference?
Lawyer Faisal Siddiqui replied that according to Article 63 A, parliamentary party and political party have been mentioned, a political party can be a parliamentary political party.
The Chief Justice said that the constitution differentiates between political party and parliamentary political party, what were you before February 8? Faisal Siddiqui replied that before February 8 we were a political party, after the joining of independent candidates we became a parliamentary party.
Justice Qazi Faiz Isa said that tomorrow Sunni Ittehad Council and Tehreek-e-Insaaf can stand against each other. Lawyer Faisal Siddiqui said that the issue of PTI and Sunni Ittehad Council becoming rivals in the Supreme Court is not related.
The Chief Justice told lawyer Faisal Siddiqui that I have deleted the word political from your questions. Justice Athar Minullah asked whether it is possible to have a parliamentary party without being a political party. Whichever party will be in the assembly will be the parliamentary party.
On this occasion, arguments were made in the Supreme Court on the difference between the words political party and parliamentary party. Lawyer Faisal Siddiqui said that apart from 63 A, the word parliamentary party will not be seen anywhere in the constitution, an independent candidate is one who does not contest elections on any party platform.
Justice Qazi Faiz said that the candidates who are not in front of us, whom you are representing, are all from Tehreek-e-Insaaf, the candidates of Tehreek-e-Insaaf are leaving you, they are not coming to your party, the candidates of Tehreek-e-Insaaf are leaving you. Then they were not released.
Justice Ayesha Malik said that on what basis did the Election Commission declare the candidates independent? The Election Commission recognized the candidates as independent and allowed them to contest the election.

Justice Athar Manullah said that PTI was complaining that the real stakeholder, the voters, who are not in front of us, is not getting a level playing field.
