Islamabad: The Supreme Court inquired during the Military Courts case that how was the distinction made between the military and anti-terrorism courts for the May 9 cases?
During the hearing, Justice Naeem Akhtar Afghan, while talking to the lawyer of the Ministry of Defense, Khawaja Haris, said that you are carrying a basket full of questions. Take my question in a basket too.
Justice Naeem Akhtar Afghan said that cases were tried against 103 accused in the May 9 incidents in military courts. The remaining cases are being tried in anti-terrorism courts. How was this distinction made as to which case will go to military courts and which case will go to anti-terrorism courts?
Justice Naeem Akhtar Afghan inquired that where is the detailed decision of the anti-terrorism courts to hand over the accused to the army?
Justice Jamal Khan Mandokhel said, “Who and how decides where a case will go for a crime? Where cases are to be tried, how and on what principles is the distinction made?”
