Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur has approached the Peshawar High Court on the Election Commission’s notice on assets.
The Election Commission has been made a party in Ali Amin Gandapur’s petition against the notice on assets filed in the Peshawar High Court. The petition has taken the position that the petitioner is the Chief Minister of the province and an elected member of the assembly from provincial constituency 113.
According to the petition, Chief Minister Ali Amin Gandapur had submitted all the records related to his assets and returns to the relevant authorities before the elections. The Election Commission had declared the petitioner eligible after scrutiny. After the elections, the Election Commission issued a notice on assets to the Chief Minister in April last year. The said notice was suspended by the Peshawar High Court and stopped the Election Commission from taking action. Now the Election Commission has again issued a notice on assets to the Chief Minister on November 20 last year.
The petition took the position that once the declaration of the successful candidate is issued, the Election Commission no longer has the authority to take action. After the establishment of election tribunals, the Election Commission also no longer has the authority to hear election matters. The job of the Election Commission is to hold elections. The purpose of issuing notices by the Election Commission is to harass the Chief Minister. The Election Commission wants to hang a sword on the head of the Chief Minister through notices.
The petition requested the Peshawar High Court that the notice has been issued on the basis of political vendetta, it should be suspended and the action should be stopped.
