Islamabad: The Constitutional Court, established in the Supreme Court, dismissed the review petition against the appointment of Qazi Faiz Isa as Chief Justice of Balochistan High Court.
A six-member constitutional bench headed by Justice Aminuddin Khan heard the case. Advocate Riaz Hanif Rahi had filed a review petition.
Riaz Hanif Rahi said in his arguments that he should be given five minutes for his submissions, to which the court remarked that the review was not ineffective.
Justice Mussrat Hilali remarked that now let Qazi Faiz Isa live, this rostrum is not for political speeches.
Justice Mandokhel said that this is a review, the case cannot be reopened, lawyer Riaz Hanif Rahi said that the court decided on the Bhutto case after 40 years. Justice Mussrat Hilali said that the Bhutto reference was a different case and the facts were also different.
Justice Muhammad Ali Mazhar said in his remarks that lawyer sir! You are not listening and what are you getting angry about.
Riaz Hanif Rahi said that the court should first look at the grounds for review, the Chief Minister was not consulted when Qazi Faiz Isa was appointed as the Chief Justice of the Balochistan High Court.
Justice Jamal Khan Mandokhel remarked that in the review, first identify what is wrong in the decision and show the law where it is written that consultation with the Chief Minister is mandatory.
The head of the bench, Justice Aminuddin Khan, said that the consultation process can also be oral, lawyer sir, this is not a procedure, what is the legal question after reading paragraph 8.
Justice Jamal Khan Mandokhel remarked that in my opinion, the case of lawyer Riaz Hanif Rahi should be sent to the Pakistan Bar Council on a false application.
