The Chief Justice asked the FIA officer that how are the provisions that were imposed unfairly? Is there any teaching in your institution? If there is none, then get it translated into Urdu. Did we complain to you against the journalists? Did you send notices to the journalists by naming the judges? Are you using our shoulder to get your work done? Serious provisions have been imposed in the case against Asad, how are other provisions including sensitive information applied? In the inquiry notice, it was written that the campaign against the judiciary is being summoned, the campaign against the judiciary is not even mentioned in the FIR.
The Chief Justice said that why not give a contempt of court notice to the FIA, no judge of the Supreme Court complained to the FIA, nor did the registrar. In this way, the image of the judiciary will be damaged in the public, can we now take action against the FIA for defaming the judiciary? The concerned FIA officers themselves are bringing the judiciary into disrepute.
Barrister Salahuddin requested that the notification of the JIT, which includes officials of law enforcement agencies, was set up before the cases against the journalists were registered.
The Chief Justice remarked how the representative of ISI can join the JIT? It is an intelligence agency not a law enforcement agency, law enforcement is not the jurisdiction of ISI.
Barrister Salahuddin said that FIA cannot take action against journalists under PICA, only PICA Section 20 deals with such allegations, but the complainant must be a natural person.
The Attorney General admitted that certain provisions of PICA were not applicable in the FIR.
During the hearing, the allegations of former Commissioner Rawalpindi were also mentioned.
