Islamabad: In a significant humanitarian move, President Asif Ali Zardari has announced a reduction in the sentences of eligible prisoners on the auspicious occasions of Pakistan Day (March 23) and Eid-ul-Fitr. The decision reflects the government’s commitment to justice tempered with compassion, providing relief to specific categories of prisoners who have demonstrated good conduct during their incarceration.

Presidential Order Under Article 45 of the Constitution

The sentence reductions were approved by President Asif Ali Zardari under Article 45 of the Constitution of Pakistan, which empowers the President to grant pardons, reprieves, and respites, as well as to remit, suspend, or commute sentences in accordance with the law.

The announcement includes a special reduction of 180 days in the sentences of eligible prisoners across the country. This decision is expected to benefit thousands of inmates, allowing them to reunite with their families sooner and reintegrate into society as responsible citizens.

Eligibility Criteria for Sentence Reduction

While the sentence reduction offers relief to a significant number of prisoners, it comes with strict eligibility criteria to ensure that only deserving individuals benefit from the move. The remission will apply to:

  • Male prisoners over the age of 65, who have served at least one-third of their total sentence.
  • Female prisoners over the age of 60, who have served at least one-third of their total sentence.
  • Female prisoners who are incarcerated with their children.
  • Juvenile prisoners (under 18 years of age) who have completed one-third of their sentence.

Exemptions: Who Will Not Benefit from the Reduction?

The government has imposed clear restrictions to prevent convicted criminals involved in serious offenses from taking advantage of the sentence reduction. Prisoners convicted of the following crimes will not be eligible for any reduction in their sentences:

  • Murder
  • Espionage
  • Anti-state activities
  • Terrorism
  • Kidnapping
  • Robbery and theft
  • Adultery-related offenses
  • Financial crimes that harm the national treasury

These limitations ensure that the sentence remission serves as a humanitarian relief measure rather than an avenue for hardened criminals to escape full justice.

Impact and Significance of the Decision

The decision to grant sentence reductions on Pakistan Day and Eid-ul-Fitr holds significant importance in multiple ways:

1. Promoting Rehabilitation and Reintegration
