Islamabad: The Constitutional Bench of the Supreme Court heard eighteen cases on the first day, the court dismissed the case against the appointment of Qazi Faiz Isa as Chief Justice of Balochistan High Court.
A 6-member Constitutional Bench headed by Justice Aminuddin Khan and comprising Justice Jamal Khan Mandokhel, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Musarrat Hilali and Justice Naeem Akhtar Afghan heard the petitions.
The first case was heard regarding 31-year-old environmental pollution. The Constitutional Bench sought a report from the four provinces and the federal government on measures taken to reduce environmental pollution.
Justice Aminuddin Khan remarked that only paperwork will not work, practical steps will be taken. During the hearing of the case regarding the appointment of Qazi Faiz Isa as Chief Justice of Balochistan, lawyer Riaz Hanif Rahi took the position that no person can be directly appointed as Chief Justice.
The Chief Minister of Balochistan had not even sent the summary of the appointment. Justice Jamal Mandokhel remarked that the original case cannot be reopened in the review. This is not an appellate bench against court decisions, why not send your case to the Bar Council on a frivolous application.
When the lawyer referred to the Bhutto case, the court said that the Bhutto reference was a different case and the facts were also different. Justice Musarrat Hilali said that cases do not come down to personal matters, leave the life of Qazi Faez Isa now, this case seems less legal and more political, the constitutional bench dismissed the review petition filed against Qazi Faez Isa.
The petitions for amendment of the election schedule of February 8, 2024, against foreign assets and bank accounts, and ban on marriages of Pakistanis to foreign women were also dismissed. A total of Rs 60,000 was imposed on the petitioners for baseless litigation.
The Constitutional Bench has issued a notice to the petitioner again on the petition filed against the appointment of Arif Alvi as the President. The Constitutional Bench has completed the hearing of 18 cases, proceeded with the proceedings on four cases, and disposed of 14 cases.
The Constitutional Bench has dismissed the petition to ban marriages of Pakistanis with foreign women and imposed a fine of Rs 20,000 on the petitioner.
The Constitutional Bench has issued a notice to the petitioner for re-hearing on the petition filed against the appointment of Arif Alvi as the President.
In the Review of Judgments and Orders case, Additional Attorney General Amir Rehman said in his arguments that the court decision has given an observation on the legislative power of Parliament. Justice Jamal Khan Mandokhel remarked with a smile, “Now you have also amended the Constitution.”
Justice Aminuddin Khan remarked that in the Practice and Procedure Act case, the Supreme Court has recognized the legislative power of Parliament. The bench disposed of the case due to its ineffectiveness.
