ISLAMABAD: After failing to approve the proposed constitutional amendment on the judicial package, the federal government is facing opposition from its allies regarding the extension of Chief Justice Qazi Faiz Isa as the Chief Justice of the Federal Constitutional Court.
Government sources have revealed to The Express Tribune that the federal government is also of the view that the appointment of Qazi Faiz Isa as the Chief Justice of the proposed Federal Constitutional Court would not be appropriate.
Sources have confirmed that the government’s legal team received the draft constitutional amendment on Friday. A section in the government has suggested that the notification of the appointment of Justice Syed Mansoor Ali Shah as Chief Justice should be issued immediately, on the other hand, a lawyer says that even if the notification is issued, the judges will be subject to doubts. Although there is very little chance of extending the term of Chief Justice Qazi Faiz Isa, still the government will try to establish a federal constitutional court.
The pro-government independent group in the Supreme Court Bar Association organized a convention in which Prime Minister Nazir Tarar was also invited to answer questions on the proposed constitutional amendment. Azad Group chief Ahsan Bhavan wondered how the Prime Minister could appoint the Chief Justice of the proposed Constitutional Court.
Ahsan Bhavan suggested that the appointment of the Chief Justice of the proposed FCC should be done by a parliamentary committee. On the other hand, 16 retired judges have authorized senior lawyer Munir A. . Munir A. Malik was leading the lawyers’ movement in 2007.
A retired Supreme Court judge from Sindh province has confirmed to The Express Tribune that he has authorized Munir A. Malik to challenge the establishment of a federal constitutional court. (f) If there is no agreement on the amendment, the proposed constitutional amendment regarding the establishment of the FCC is not possible. On the other hand, Pakistan Tehreek-e-Insaf is also in touch with Maulana Fazlur Rehman. They just want Chief Justice Isa to retire on October 25. After his retirement, the government will not be in a position to curtail the powers of the Supreme Court.
