Supreme Court Justice Jamal Mandokhel has remarked that if there is a difference between Form 45 and 47, then one of them will be correct.
A six-member constitutional bench headed by Justice Aminuddin Khan heard the case against rigging in elections. Advocate Hamid Khan, on behalf of petitioner Imran Khan, asked the court whether jurisdiction has been given in Article 184 (3) or not.
Justice Jamal Mandokhel, while talking to Advocate Hamid Khan, said that if you think the Election Commission is biased, then you should have gone to the relevant forum. You will have to tell the court for the notification of each candidate. If there is a difference between Form 45 or 47, then one of them will be correct. A full inquiry will have to be conducted to examine the form.
Justice Muhammad Ali Mazhar said that Hamid Sahib, you should come prepared for the next hearing, to which Hamid Khan said that I had only come to remove objections, you are talking about merit.
Justice Jamal Mandokhel asked whether the entire election from Khyber Pakhtunkhwa to Balochistan was wrong? The issue of rigging in the elections had been raised earlier too, an ordinance had to be brought for an inquiry, we did not have the authority to take action, so an ordinance had to be made, the jurisdiction of the court is not under 184.
Hamid Khan Advocate said that this is the weakness of this court that it has not yet been able to take suo motu, to which Justice Jamal Mandokhel said that Hamid Sahib, you are a senior lawyer, look at the choice of words.
Later, the court adjourned the hearing of the case for an indefinite period, giving Hamid Khan time to prepare.
