Islamabad: The Constitutional Bench of the Supreme Court has adjourned the hearing for an indefinite period on the issue of formation of a judicial commission related to the May 9 incident, giving time to the PTI to submit more documents.
A five-member Constitutional Bench headed by Justice Aminuddin Khan heard the petition of the founder of PTI. The founder of PTI, Hamid Khan, gave arguments regarding the formation of a judicial commission on the May 9 incident.
Justice Aminuddin Khan asked what is the request in your petition?
Lawyer Hamid Khan said that a judicial commission should be formed on the May 9 incident. There has been talk of forming a judicial commission consisting of the Chief Justice and two senior judges of the Supreme Court and the second request is that a military trial of a civilian should not be conducted.
Justice Muhammad Ali Mazhar remarked that your request regarding the military trial of a civilian has become ineffective, that is a separate case. Can we see the matter of formation of a judicial commission in Clause 3 of 184?
Imran Khan’s lawyer Hamid Khan said that May 9 is a national event but there was no judicial inquiry into it.
Justice Muhammad Ali Mazhar questioned whether you have requested a judicial commission anywhere in the case regarding the trial of a civilian in the military courts? Hamid Khan replied that no, in this case we have not made any request regarding the formation of a judicial commission.
Justice Jamal Mandokhel remarked that you have written in your application that dozens of civilians died in the May 9 incident, have you attached the death certificate of any citizen who died on May 9? You could have shown us a single certificate. Justice Jamal Khan Mandokhel
Justice Aminuddin Khan raised the question whether any private complaint was filed regarding civilian deaths? If there was an FIR, show it. Justice Hassan Azhar Rizvi said that there would have been media reports about the civilians killed in the May 9 incident.
The Supreme Court’s constitution bench adjourned the hearing indefinitely, giving time to the PTI to submit more documents.
